1. Agreement to These Terms
These Terms and Conditions ("Terms") are a binding agreement between you and AthleteXpert ("AthleteXpert," "we," "our," or "us"). They govern your access to AthleteXpert.org and our related content, accounts, recommendation tools, and other services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, you may use the Services only with permission and supervision from a parent or legal guardian who agrees to these Terms. You may not use the Services if applicable law prohibits you from doing so.
3. Accounts and Security
You must provide accurate account information and keep it reasonably current. You are responsible for safeguarding your credentials and for activity under your account. Do not share access or attempt to use another person's account. Notify us promptly at contact@athletexpert.org if you suspect unauthorized access.
You may update profile information or delete your account through account settings. We may reject a username or other profile content that is unlawful, misleading, infringing, or reasonably likely to harm another person or the Services.
4. Information, Recommendations, and Activity Safety
AthleteXpert provides general sports, fitness, product, and lifestyle information. The Services are not medical, legal, financial, nutritional, or professional training advice and do not create a professional-client relationship. Content and recommendations may not account for your health, experience, equipment, or circumstances.
Physical activity carries inherent risks. Use appropriate equipment, follow manufacturer instructions, understand your limits, and consult a qualified health care or training professional before beginning or changing an activity when appropriate. Stop an activity and seek medical attention if you experience symptoms that concern you. Never disregard professional advice because of content on the Services.
5. Affiliate Disclosure and Third-Party Purchases
AthleteXpert participates in affiliate programs and may earn a commission when you follow an eligible link and make a purchase, at no added cost to you. As an Amazon Associate I earn from qualifying purchases. Any sponsored relationship or other material connection will be disclosed with the relevant content where required.
Product descriptions, prices, ratings, promotions, availability, and merchant policies can change and should be verified with the merchant before purchase. AthleteXpert is not the seller and does not process, fulfill, ship, warrant, return, or refund third-party products. Your transaction is with the merchant and is governed by its terms, privacy policy, and customer-service policies.
Links to third-party services are provided for convenience. We do not control and are not responsible for a third party's availability, content, security, products, or conduct. A link does not imply endorsement beyond what the accompanying content expressly states.
6. Acceptable Use
You may not:
- Use the Services for unlawful, fraudulent, deceptive, or harmful conduct.
- Interfere with the availability, security, integrity, or operation of the Services.
- Attempt unauthorized access to a system, account, or nonpublic information.
- Introduce malware or use the Services to distribute spam or abusive material.
- Impersonate another person or misrepresent your identity or affiliation.
- Scrape, harvest, crawl, reverse engineer, or copy the Services at scale except as permitted by law or our express written authorization.
- Infringe intellectual property, privacy, publicity, or other rights, or submit content that is threatening, defamatory, obscene, or otherwise unlawful.
- Circumvent access controls, rate limits, or security measures.
7. Intellectual Property and Limited License
The Services, including original text, design, graphics, software, branding, and the selection and arrangement of content, are owned by AthleteXpert or our licensors and are protected by applicable intellectual property laws. Merchant names, product images, and third-party marks belong to their respective owners.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, non-commercial use. No other rights are granted by implication or otherwise.
8. Submissions and Feedback
You retain ownership of content you submit. Where a feature allows you to post or submit content for display through the Services, you grant AthleteXpert a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, and display that content only as reasonably necessary to operate and provide the feature. This license ends when the content is deleted from our active systems, except for limited backup, legal, or technical retention.
If you voluntarily provide ideas or feedback about the Services, you grant us a perpetual, worldwide, royalty-free right to use that feedback without restriction or compensation. This feedback license does not give us a right to publish private communications or personal information contrary to our Privacy Policy.
You represent that you have the rights needed to submit your content and grant the applicable license. We may remove or restrict content that violates these Terms or creates legal, security, or user-safety risk, but we are not obligated to monitor every submission.
9. Copyright and Rights Concerns
If you believe material on the Services infringes your copyright or another right, email contact@athletexpert.org with your contact information, identification of the protected work or right, the specific material and its location, the basis for your concern, and a statement that the information in your notice is accurate. We may request additional information before acting.
10. Privacy and Electronic Communications
Our Privacy Policy explains how we process personal information. By providing an email address, you agree that we may send transactional messages reasonably necessary to administer your account or requested Services. AthleteXpert does not currently promise a marketing newsletter; if one is offered later, any legally required consent and unsubscribe controls will apply.
11. Service Changes and Availability
We may add, change, suspend, or discontinue features, content, or integrations. We do not guarantee that the Services or any particular product listing, link, or item of content will always be available. We may correct errors and update content without notice. Where reasonably practical, we will provide notice before a change that materially reduces a paid service, if any.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." ATHLETEXPERT DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT, RECOMMENDATIONS, PRODUCT INFORMATION, OR THIRD-PARTY LINKS WILL BE COMPLETE, ACCURATE, CURRENT, OR SUITABLE FOR YOU. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHLETEXPERT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID ATHLETEXPERT FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR USD $100.
THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING WHERE APPLICABLE LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR PERSONAL INJURY CAUSED BY NEGLIGENCE. YOUR JURISDICTION MAY PROVIDE ADDITIONAL RIGHTS.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless AthleteXpert and its affiliates, officers, employees, contractors, and agents from third-party claims, damages, and reasonable costs arising from content you submit, your unlawful or willful misuse of the Services, or your material violation of these Terms or another person's rights. This obligation does not apply to the extent a claim results from AthleteXpert's own unlawful conduct.
15. Dispute Resolution and Governing Law
Before filing a legal claim, you and AthleteXpert agree to make a good-faith effort to resolve the dispute informally for at least 30 days after written notice. A notice to AthleteXpert must be sent to contact@athletexpert.organd describe the dispute and requested resolution. This requirement does not prevent either party from seeking urgent injunctive relief or filing an eligible small-claims action.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules, except where federal law or the mandatory consumer law of your residence applies. Any court proceeding must be brought in a state or federal court with jurisdiction in Pennsylvania, and each party consents to that court's jurisdiction, unless applicable consumer law gives you the right to bring a claim elsewhere.
16. Suspension and Termination
You may stop using the Services at any time and may delete your account through account settings. We may suspend or terminate access if we reasonably believe you violated these Terms, pose a security or legal risk, or used the Services in a way that could harm another person or the Services. Where appropriate, we will provide notice and a reasonable opportunity to address the issue.
Provisions that by their nature should survive termination—including intellectual property ownership, the feedback license, disclaimers, liability limits, dispute terms, and general provisions—will survive.
17. General Terms
These Terms and the Privacy Policy are the entire agreement between you and AthleteXpert regarding the Services and replace prior agreements on the same subject. If a provision is unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or transfer of the Services. There are no third-party beneficiaries unless these Terms expressly say otherwise.
18. Changes to These Terms
We may update these Terms to reflect changes to the Services, law, or our practices. We will post the revised Terms, update the date above, and provide additional notice when required. Changes apply prospectively. If you do not agree to revised Terms, you must stop using the Services.
19. Contact
Questions or legal notices about these Terms may be sent to contact@athletexpert.org.
